Terms and Conditions

Please ensure you have read my terms and conditions before purchasing artwork or ordering a commission.

Commissioned Work – Portraits

Deposits
A 25% deposit is required to secure your portrait and time slot. Clients will be advised of the approximate completion date at the time of ordering. Portraits will not be deemed as ordered until the deposit has been received. Payment terms will be provided in writing prior to accepting your commission and receiving your deposit. 

Payments
The remaining final balance will be invoiced upon completion and approval of the portrait and must be paid in full prior to your portrait being shipped.

Payments can be made securely online via bank transfer, or Paypal (credit/debit card).

Cancellations
1 week before I commence work on your portrait I will notify you via email and you will have 7 days from this notice in which to make any changes or cancel the order and a refund of your deposit will be issued. After this point, the deposit amount will be retained to cover the artist’s time, administration, and materials used.

Changes and rejection of finished portrait
Once the portrait has been completed, a digital copy of the portrait will be emailed to you for your approval with the option of making any adjustments and alterations as far as the artist is able, in line with the client’s original portrait expectations. Clients have 7 days to contact me about any required changes. Once the portrait has been delivered, further alterations will not be possible.

If the client is not happy with the finished portrait on receipt, clients will receive a refund minus the deposit plus 25% of the balance. The refunded amount will be paid after the portrait has been returned in its original condition.

Framing
I do not offer a framing service. The client is advised to await receipt of the portrait before ordering any frame to ensure a good fit.

Lead Time
Lead time will depend on the time of year and the number of other portraits booked in my schedule. I will provide an estimated completion date upon your enquiry. For specific dates (e.g. for a Birthday) I will try my best to accommodate any special request.

Delivery
I ship portraits worldwide using DHL, Parcel Force, Royal Mail, UPS International depending on the destination. Delivery time is approximately 1-3 days within the UK and 3-15 days outside the UK. Delivery within the UK is included in the portrait cost. For overseas buyers delivery charges will be calculated and applied to the invoice.

Packaging and Shipping
Drawings will be packaged sufficiently enough so that damage is prevented as best as it can be during transit. I package all my original work myself in my studio with acid-free plastic wrap and protected with several layers of sturdy cardboard.

Shipping Timescale
Portraits will be shipped within 3 working days of receipt of the final balance payment.

Loss/Damage in Transit
Original works are packaged extremely well however in the unlikely event that damage occurs during transit please send a photo of the damaged artwork and the package in which it was received, immediately, along with a description of the problem to klair.wellings@gmail.com Your issue will then be reviewed and if it is determined that there is a problem during shipping, your item will be replaced.

You must inform us within 3 working days if the artwork has been lost or damaged in transit so we can rectify the problem. You agree that proof of delivery supplied by the delivery couriers is evidence that your work has been received.

Certificates of Authenticity
All my original work comes with a certificate of authenticity.

Guarantee
I personally guarantee that my original drawings will last for many years to come. I use the highest grade archival materials in creating my artwork; using lightfast pencils and acid-free archival paper, both of which ensure that every drawing is ready to withstand the ages. If the client has requested the use of any materials beyond the standard, care instructions will be provided to ensure that environmental factors will not damage the artwork. 

Payment
Payment will be organised between the buyer and myself (the artist) and confirmed in writing prior to dispatch. Payment can be accepted by bank transfer, or via Paypal (credit/debit card). Full payment must be received before artwork is shipped.

Copyright
The artist retains full copyright on all artwork that is produced, including originals, mock-ups and prints. When a portrait is commissioned I reserve the right to display it on my website gallery and on my social media pages. Clients who do not wish their commissioned portrait to be shown online must notify me before work commences.

Portraits
Clients may use a digital copy of their artwork to display on social media/web or for any other personal use. However, the use of the image to make physical copies or to reproduce on merchandise, for sale, or any other commercial or public activity is not permitted without prior consent from the artist.

Bespoke Illustration / Design
Usage rights of digital illustration and design work will be confirmed on an individual basis

Website
All images on this website are the sole property of Klair Wellings Illustration and are fully protected by the appropriate international copyright laws. The use of any images from this website without permission to advertise, reproduce or use in any manner is not permitted and Klair Wellings Illustration reserves the right to take full legal action upon anyone found doing so.

VAT & Import Duty
All items for sale including commissions are not subject to Value Added Tax. Payment of import duty may be liable in some countries, which is the sole responsibility of the client.

Privacy Policy
Klair Wellings Illustration is committed to protecting your privacy. Customer information is solely used for the purpose of fulfilling orders and is never shared with any third parties. Email addresses provided by customers may be used in the future by Klair Wellings Illustration to notify them of special offers, updates and artist news, and will never be shared with anyone.

Disclosure
We may disclose your personal information if we are required by law to do so or if you violate our terms and conditions of service.
